The Importance of the General Counsel Role

In this very recent case out of the Georgia Court of Appeals, we see a court once again consider the issue of the degree to which a law firm’s communications with its own counsel (aka “Firm Counsel” or “General Counsel”) are protected as privileged communications.

It should be of particular interest to Oswald’s law firm clients because of the guidance the Court offers in determining whether a law firm has a conflict in asserting a privilege against its own client.  Once again, having the formal role of firm counsel already established pays big benefits.
